Balloon Flights Over Melbourne Pty Ltd ABN 44 110 432 463 Liability Release

Hot air ballooning is a truly amazing way to experience lighter than air travel and a flight over Melbourne provides passengers with the most unique perspective of our wonderful city imaginable. However ballooning by nature is an adventure activity.

All passengers (or if under the age of eighteen years their guardians) are required to read the following disclaimer, print their name and then sign and date in the space provided to release Balloon Flights Over Melbourne Pty Ltd and its directors and employees from any liability which may arise from an incident or accident whatsoever.

Balloon Flights Over Melbourne Pty Ltd is licensed by the Civil Aviation Safety Authority (CASA) to conduct commercial passenger hot air balloon flights. Air Operator's Certificate no: 598425.

Safety is always the Chief Pilot's first consideration each morning and a hot air balloon flight will only take place if the pilot-in-command decides that the weather conditions are suitable for a flight. At times because of the weather or other circumstances, balloon landings can be hazardous. Passengers must be aware that occasionally a landing may be faster or harder than usual and may subject passengers to abnormal stress.

No responsibility can be accepted by the pilot-in-command or Balloon Flights Over Melbourne Pty Ltd if a passenger sustains an injury before, during or after a flight. Please inform Balloon Flights Over Melbourne if you have any pre-existing medical conditions or if you are under medical supervision for any condition which may affect your participation.

On the morning of the flight passengers will be provided with the above information and will be required to acknowledge they have read the information and provide a signature of acknowledgement.

Photographic Stills and Video Footage
Balloon Flights Over Melbourne takes in-flight photos of passengers and may also take video footage during the morning. Balloon Flights Over Melbourne reserves the right to use the material for its own promotional purposes.

Ticket / Voucher Validity
Tickets are valid for use for 12 months from date of purchase.

Tickets may be extended beyond the 12 month validity period for 3 months immediately beyond ticket expiry if you have made a reasonable attempt to take your flight during that initial 12 month validity period. A reasonable attempt is considered to be two attempts to fly that have been cancelled due to unfavourable weather in the ticket's initial 12 month validity period.

When a passenger has not made a reasonable attempt to go ballooning in the initial 12 month validity period and wants to extend their ticket for 3 months immediately past initial expiry date a fee of $50.00 per ticket is payable.

Tickets may be transferred to another person within the 12 month validity period. The purchaser of the ticket is required to provide Balloon Flights Over Melbourne in writing a letter to acknowledge the transfer to the new recipient.

Open dated flight vouchers are valid for use for 12 months from the date of purchase and are non-refundable.

Cancellation Conditions
If you wish to cancel or change your flight date, Balloon Flights Over Melbourne requires a minimum of three (3) full business days to replace you on a flight. Larger groups of 4 or more passengers require five (5) full business days notice to cancel or change a flight date. A business day does not include weekends or public holidays. Cancellation conditions apply to all bookings and or re-bookings. Passengers failing to turn up for their flight at the predetermined time are considered "No Shows" and will not be rebooked or refunded.
